1. Scope and Purpose
These general conditions of accession aim to regulate the terms and conditions governing the use and provision of services offered by the public e-procurement platform - ComprasPT (www.compraspt.com). ComprasPT is managed by MIROMA - Serviços e Gestão de Participações, Lda., which owns all the intellectual property rights of this platform.
These terms and conditions of accession must be read by all users before accessing the platform. When joining ComprasPT services, the customer declares his knowledge, understanding and acceptance of all general conditions expressed in this document.
2. Access Conditions
ComprasPT provides a set of base services that include the access to all functionalities essential to the operation with the platform and to the total development of public pre-contractual procedures, free of charges to the economic operator.
The customer shall appoint a user responsible for handling all matters related to the use of the platform and management of digital certificates at an administrative, technical and financial level.
The access to the platform is granted once the customer registration is done and his data is confirmed and validated. In order to access ComprasPT, the login should be done with the user's digital certificate.
3. Base Services
The base services provided by ComprasPT include the access to all essential functionalities that allow the full and complete development of public pre-contractual procedures, namely:
a) Access to procedures and parts of the procedure that have been published;
b) Messages sending through the electronic platform;
c) Email messages sending to all those involved in the formation stage of ongoing public procurement procedures, when, under the terms of the Public Contracts Code (PCC) , such communication is mandatory;
d) Clarification requests and lists of errors and omissions;
e) Applications, proposals and solutions submission;
f) Charges in pre-trial hearings;
g) Complaints and challenges;
h) Award decision;
i) Qualification documents delivery;
j) Display of all messages and notices created by contracting entities to which suppliers must have access, accordingly to the law. The access to the base services of ComprasPT is granted to economic operators registered in this platform.
The base services of ComprasPT are accessible to economic operators registered in this platform, and include 3 users (accesses) for free, in accordance with the legislation in force.
4. Technical Support Services
ComprasPT provides technical support services, from 9 a.m. to 7 p.m. (no interruption), on working days. This service is assured to all users through different channels of communication: telephone, email and online chat..
5. Safety
ComprasPT platform follows security, integrity and availability information standards, at the highest level. Being fully compliant with the best practices and international safety standards ISO / IEC 27002/27001, CobiT, NIST, Sarbanes-Oxley, ITIL and Basel II, it ensures real added value for the entire user community.
6. Use of ComprasPT Platform
ComprasPT not only meets the requirements of the Portuguese Decree-Law no. 18/2008 of January 29, which approves the Public Contracts Code, amended and republished by Decree-Law no. 111/B/2017 of August 31 and rectified by Rectification no. 36-A/2017 of October 30 and Rectification no. 42/2017 of November 30, but also the law that regulates the use of e-procurement platforms (Law no. 96/2015 of August 17).
The use of the platform is possible through a common internet browser, based on a secure communication over HTTPS protocol (HyperText Transfer Protocol Secure). Information confidentiality is ensured once all transacted information is encrypted.
When using ComprasPT (www.compraspt.com), it implies uploading, storing, downloading and sending information. Users are fully responsible for the content of that information.
7. Rights and Obligations
7.1. From ComprasPT to Customer:
7.1.1. To ensure customers’ access to all information about technological conditions and technical requirements needed to operate with the platform;
7.1.2. To ensure a secure authentication process, as well as the confidentiality of the information through a submission process of encrypted and signed documents, using qualified digital certificates and chronological validation;
7.1.3. To ensure information integrity, through processes that prevent destruction, loss, diversion, access violation and modification, illegitimate or unauthorised exposure;
7.1.4. To ensure the operation and monitoring of the applicational infrastructure;
7.1.5. To ensure the supervision of security procedures and information safeguarding.
7.2. From Customer to ComprasPT:
7.2.1. To ensure that all users fulfill ComprasPT general conditions of accession described in this document.
7.2.2. Not to publish, send or allow the sending of any defamatory, illicit or abusive information through the platform;
7.2.3. To ensure the confidentiality of access data and prevent any abusive use, assuming full responsibility for its use by third parties (when accessing the services offered by ComprasPT);
7.2.4. Not to jeopardise the security of the network, in particular by sending or transmitting viruses, worms or other bugs via platform or other techniques that may jeopardise its good performance;
7.2.5. To report, within a maximum of 24 hours, anomalies that you have become aware of, such as the loss, transmission or any violation of your access data.
8. Privacy
This Privacy and Personal Data Protection Policy explains the terms under which ComprasPT/MIROMA processes the personal data of its Customers/Users, as well as the rights they may exercise, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council - General Data Protection Regulation (GDPR) - and other applicable national legislation on privacy and data protection, in particular Law No. 58/2019 of August 8 which ensures the implementation in Portugal of that Regulation.
The personal information collected may include your name, email address, phone or mobile number, address, date of birth and other information. By using the ComprasPT website, you are accepting this Privacy Agreement. The ComprasPT website maintenance team reserves the right to do readjustments or changes to this Privacy and Personal Data Protection Policy at any time and without prior notice. Therefore, we recommend that you consult our privacy policy regularly in order to be always updated.
